how to work with me

I've had a bunch of questions lately about what kind of lawyers I work with and the different ways to work with me, so I thought it might be a good time to send out this summary.

Who do I work with?

  • criminal defense lawyers
  • civil plaintiffs lawyers
  • family law attorneys in states where cases are tried to juries

I do not work with lawyers who work for governments, insurance companies, or large corporations.

What do I help lawyers do?

I help lawyers use creative and compelling stories to increase their odds of getting a win for their clients. In the process, I increase their confidence and reduce the stress and overwhelm that comes with the difficult work that these lawyer-heroes do every day.

Let's take a look at some of my most popular services:

Focus Groups

My most popular service, and the one that gives you the most bang for your buck, is focus groups. Most of my focus groups are mock trial-style. We bring in 8-12 mock jurors, either in-person or via zoom, and simulate voir dire, opening statements, and testimony. There are both zoom and in-person options available.

The reason why this service is so popular is because you get SO MUCH support and feedback. Not only do you get the incredible feedback of the mock jurors, which in many cases turns out to be invaluable in creating your final trial strategy, but you get all of these things done for you:

  • review of necessary discovery and transcripts
  • a detailed focus group plan
  • drafting of your voir dire
  • drafting of your opening statement
  • preparation of transcripts for the testimony in the mock trial
  • preparation of voir dire for opposing counsel for the mock trial
  • preparation of opening statement for opposing counsel for the mock trial
  • preparation of cross examination to test out your client's testimony
  • a detailed post-focus group report with recommendations about voir dire, opening statement, direct examination (if applicable), cross examination, and closing argument and a summary of mock juror deliberations
  • a video of the focus group
  • finalized voir dire adjusted based on focus group feedback
  • finalized opening statement adjusted based on focus group feedback

One of the things that my clients love best is that they get so much value out of the focus groups, but they don't have to spend hours on end preparing for it.

Preparation of Client Testimony

There are cases, both civil and criminal, where our client's testimony is critical. So, what's my process to help you and your client prepare for this task?

The steps look like this:

  • We work to map out your trial story and identify the areas of your story that can only come in through your client (and the areas we can exclude from the client's testimony because they will be better covered by another witness).
  • I help you create a clear, concise roadmap for direct examination.
  • I spend time working with you and your client on delivery of the questions and testimony.
  • I test your client with a prepared cross examination.
  • We make adjustments as needed.

General Case Consulting

You are overwhelmed with trial preparation and need some support on things like strategy, drafting voir dire, opening statement, cross examination, or closing argument. I can provide that help and support on an hourly basis.

Mini-Consults

You're struggling to find your focus on where to take your trial story, and jumping on a zoom call with someone who gets it would really help. I'll help give you direction in 90-minutes.

Full Day Consults or Multi-Day Consults

I travel all over the country working with lawyers and their clients on story development for their cases, and have a day rate available for full day or multi-day consults.

Live workshops and video webinars

I love consulting on cases, but my true love is teaching this method of storytelling in trial to other lawyers. A complete collection of my video webinars can be found here.

I love nerding out about storytelling ... and Erin Gerner invited me onto her podcast, Powerhouse Lawyers, to do just that. As a young lawyer, I received plenty of bad advice. I learned many bad trial habits that I ultimately had to unlearn. I've spent a lot of time wishing that I'd had better resources and better mentors early on in my career. So when I see bad advice being given to other lawyers, it gets under my skin a bit. There's one piece of bad advice that I see given often that really grates on me: Cross examination is about "poking holes" in your opponent's story. If you're a lawyer and you're reading...

Let’s rewind 2 decades to one of my early trials. My client is accused of trying to run his estranged wife over with his truck. A major pretrial issue is whether the prosecutor will be able to get my client’s criminal history into the trial. I file a motion in limine to exclude it, which the judge hears on the morning of trial. We spend 30+ minutes arguing about the issue, and the judge rules in my favor. My client is watching the show, and I assume that he understands the judge’s ruling -...
